Acceptable Use Policy

The purpose of this policy is to ensure that Klingobanana is used responsibly and lawfully, and that all users can enjoy the platform in a safe environment. This policy applies to all content you upload or submit to the platform (“User Content”) and all content you generate through the platform (“Generated Outputs”), as well as to your conduct on and use of the platform more generally.

You are responsible for ensuring that your use of the platform complies with this AUP, our Terms of Service, and all applicable laws and regulations in your jurisdiction. Ignorance of this policy does not excuse violations.

Klingobanana is a strictly SFW (safe for work) platform. You may not use the platform to generate, upload, store, or distribute any content that:

• Is sexually explicit or pornographic — including nudity, simulated sex acts, or content designed to arouse, regardless of whether the subjects depicted are real or entirely fictional.
• Depicts real, identifiable persons without their consent — including realistic synthetic images or videos (“deepfakes”) of living or deceased celebrities, public figures, or private individuals, fabricated statements attributed to real people, or synthetic voice clones of real persons used without their explicit informed consent.
• Involves minors in any inappropriate context — including sexualised depictions of persons under 18, content designed to groom, exploit, or harm children, or any content that would violate child protection laws in any jurisdiction.
• Is illegal or promotes illegal activity — including content that promotes, facilitates, or glorifies violence, self-harm, drug use, terrorism, or any other unlawful act.
• Is hateful, harassing, or discriminatory — including content that promotes hatred, incites violence, or demeans individuals or groups based on race, ethnicity, national origin, gender, sexual orientation, religion, disability, or any other protected characteristic.
• Infringes intellectual property rights — including reproducing copyrighted works, infringing registered trademarks, or using the likeness or identity of a real person in a manner that violates their personality rights or right of publicity.
• Is defamatory or misleading — including content that makes false statements of fact about real people or organisations in a way that harms their reputation, or content designed to deceive consumers or the public.

In addition to the content restrictions above, the following activities are prohibited on the platform:

• Fraud and deception — using generated content to impersonate another person or organisation, to conduct phishing attacks, to commit fraud, or to deceive people into taking actions against their interests.
• Spam and unsolicited commercial messaging — using the platform to mass-produce misleading promotional material, spam content, or any content intended for unsolicited bulk distribution.
• Automated abuse and credential stuffing — using bots, scripts, or other automated means to create accounts, trigger generations, or otherwise interact with the platform in a manner not expressly permitted through official API endpoints.
• Circumventing safety filters — attempting to bypass, disable, or manipulate the content safety filters, prompt guards, or rate limits implemented by Klingobanana or its AI model providers, including through adversarial prompting, jailbreaking techniques, or encoding.
• Reselling access — offering third parties access to the platform under your account credentials, or building a product or service that exposes our generation infrastructure to end users without our prior written consent.
• Data harvesting — scraping, crawling, or extracting data from the platform, including generated outputs created by other users, except through officially supported export mechanisms for your own content.

You may not take any action that interferes with the normal operation of the platform or that damages its integrity. Prohibited actions include:

• Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code, model weights, algorithms, or trade secrets underlying the platform or any of its components.
• Deliberately overloading the platform’s generation queues, API endpoints, or infrastructure with excessive or non-genuine requests.
• Probing, scanning, or testing the vulnerability of the platform’s systems or networks without our express written consent.
• Introducing malware, ransomware, trojans, keyloggers, or other malicious code into the platform or its supply chain.
• Intercepting or monitoring platform traffic, or attempting to gain unauthorised access to any account, system, or network associated with the platform.

If you become aware of any content on the platform or any use of the platform that you believe violates this AUP, applicable law, or any third-party rights, please report it to us at contact@klingobanana.com. Please include as much detail as possible, including the nature of the violation, any relevant URLs or account identifiers, and any supporting evidence.

We take all reports seriously and will investigate and take appropriate action where a violation is confirmed. We may not be able to share the outcome of an investigation due to privacy or legal constraints, but we appreciate every report.

We reserve the right to investigate any suspected violation of this AUP and to take appropriate enforcement action. Depending on the nature, severity, and frequency of the violation, enforcement may include one or more of the following:

• Warning — notifying you by email that your use of the platform has been flagged as a potential policy violation and providing you with the opportunity to respond or correct your behaviour.
• Content removal — removing uploaded content, generated outputs, or character profiles that violate this AUP.
• Temporary suspension — temporarily restricting or suspending access to your account or to specific platform features pending investigation.
• Permanent termination — permanently closing your account for serious, repeated, or egregious violations. For violations involving illegal content (such as child sexual abuse material), we will terminate immediately and without warning, and report to the relevant authorities.
• Forfeiture of credits — where an account is terminated for violation of this AUP, any unused subscription or top-up credits associated with that account may be forfeited without refund.

We may act on our own observation, on reports from other users, or on notifications from our AI model providers or other third parties. Enforcement decisions are made at our sole discretion. Where we take action, we will endeavour to notify you unless doing so would be unlawful or would compromise an investigation.

We may update this Acceptable Use Policy from time to time to reflect changes in the platform, the AI landscape, or applicable law. Material changes will be notified in the same manner as changes to our Terms of Service. Continued use of the platform after the effective date of any revision constitutes your acceptance of the updated policy.
